Please help - my marrriage is going down hill?

ok so back in july me and my husband had a little DV thing and my family called the cops. me and our son got kicked out of his parents house where we were livin and then the judge put a protection order on us till his sentencing so about a month later in the beginning of September the judge gave him 12month probation and community service and counseling for it beinbg his first offense i think is alot, but then he could have contact with me and he would talk to me i did my own place and i thought the day of court after he would come by and we could talk but he didn't then i went to his parents house ( were only 18 so ) and he said he wasn't sure if he still wanted to be with me and then he didn't call me for a couple of days until he wanted our son for a little bit now its the end of October he has stayed 1 night and only came bye for 1 hour and calls me every couple of days to see our son he says he loves me and wants to work things out but he never makes anytime for me and i know he isn't cheated on me he's been living with his sister and she hates so i think she is brain washing him, please help i don't know what to do i love him so much and he wont try.
