Problem with tenant eviction?

First off, always state what State you live in. In California, if a tenant know what he's doing,he can sit on your property for years with out paying rent. Unfortunately it sounds like he is getting advice on how to abuse the system. Never be too nice to your tenant. Get a lawyer, since you don't know the quality of the advice.
